Welcome to Camila’s at Tahoe.  Please acquaint yourself with the terms and conditions of this agreement (the 'Agreement') under which our services and products are offered to our customers.  If you visit the site, you agree to be bound by these terms and conditions as in effect at the time of your visit.

SECURITY

ELECTRONIC COMMUNICATIONS CONSENT

TYPOGRAPHICAL ERRORS.
 
In the event a Camila's at Tahoe product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Camila's at Tahoe shall have the right to refuse or cancel any orders placed for product or service listed at the incorrect price. Camila's at Tahoe shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Camila's at Tahoe shall issue a credit to your credit card account in the amount of the incorrect price.


USE OF MESSAGE SERVICES

You agree not to use this site to submit, transmit, or otherwise make available in any manner, including, but not limited to, sending a message card in conjunction with an order, any content (i) that is unlawful, harmful, obscene, hateful, threatening, abusive, defamatory, harassing, libelous, invasive of another's privacy, or is otherwise objectionable, (ii) that infringes the intellectual property rights of any party or (iii) which contains a chain letter or constitutes any form of mass mailing.  You may not use a false e-mail address or otherwise provide information that would be misleading as to the origin of such content.

RISK OF LOSS

All products purchased from Camila’s at Tahoe are made pursuant to a shipment contract. This means that the risk of loss and title for such products pass to you upon our delivery to the carrier.

PRODUCT DESCRIPTIONS

Camila’s at Tahoe attempts to describe the products offered on the site as accurately as possible. However, Camila’s at Tahoe does not warrant that product descriptions or other content of this site are accurate, complete, reliable, current, or error-free.  If a product offered by Camila’s at Tahoe and purchased by you is not as described, your sole remedy is to return it in unused condition for a refund or credit.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, Camila’s at Tahoe DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, SYSTEM INTEGRATION, DATA ACCURACY, AND QUIET ENJOYMENT.  Camila’s at Tahoe DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR E-MAIL SENT FROM Camila’s at Tahoe ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Camila’s at Tahoe WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

TO THE EXTENT CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, ONLY THOSE SPECIFIC PROVISIONS SHALL BE HELD INVALID AND WILL BE SEVERED FROM THE REMAINDER OF THE AGREEMENT.  THE REMAINING TERMS SHALL BE ENFORCEABLE.
APPLICABLE LAW

By visiting the site, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern this Terms and Conditions of Use agreement and any dispute of any sort that might arise between you and Camila’s at Tahoe relating to that agreement.

ARBITRATION

By using this Site, you agree that Camila's at Tahoe, at its sole discretion, may require you to submit any disputes arising from the use of this Site, or these Terms and Conditions concerning or, including disputes arising from or concerning their interpretation, violation, nullity, invalidity, non-performance or termination, as well as disputes about filling gaps in this contract or its adaptation to newly arisen circumstances, to final and binding arbitration under the International Rules of Arbitration of the American Arbitration Association, by one or more arbitrators appointed in accordance with the said Rules. Notwithstanding these rules, however, such proceeding shall be governed by the laws of the state as set forth in the previous section.

Any award in an arbitration initiated under this clause shall be limited to monetary damages and shall include no injunction or direction to any party other than the direction to pay a monetary amount. Further, the arbitrator(s) shall have no authority to award punitive, consequential or other damages not measured by the prevailing party's actual damages in any arbitration initiated under this section, except as may be required by statute.


SITE POLICIES, MODIFICATION AND SEVERABILITY

These policies also govern your visit to Camila’s at Tahoe.  We reserve the right to make changes to our site, policies, and this Terms and Conditions of Use agreement at any time and in our sole discretion; therefore, you should review those policies, terms, and conditions each time you visit the site.  Your continued use of the site after we make any such changes constitutes your binding acceptance of those changes.  If any of the terms or conditions herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.

COMPLETE AGREEMENT

This Agreement constitute the entire understanding between Camila’s at Tahoe and its users.  It cannot be amended without an express writing signed by a managerial employee of Camila’s at Tahoe.  Camila’s at Tahoe specifically disclaims the validity of an oral representation in conflict with the terms of this Agreement made by any of its employees.
